Terms of Use

Welcome to Makoto+ Japanese Explorer ("the App"), a product of Kotoba Inc ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the App and its related services. By downloading or using the App, you agree to be bound by these Terms.

If you do not agree, please do not use the App.

1. Subscription Plans

Free Tier: The App also includes a free tier allowing limited access to select stories and quizzes without payment or an account. Additional content and features require a paid subscription.

The App offers optional auto-renewable subscription plans that unlock premium content, quizzes, and interactive features. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.

2. Auto-Renewal and Billing

Automatic Renewal: Your subscription automatically renews at the end of each billing period (monthly or yearly). You will be charged for renewal within 24 hours before the current period ends, at the same rate shown above, unless you cancel.

Payment: Payment is charged to your Apple ID at confirmation of purchase. All billing and renewals are managed by Apple. We do not have access to or control over your Apple account billing information.

Price Changes: Subscription prices may change. If they do, Apple will notify you in advance and ask for your consent before renewal at the new rate.

3. Cancellation and Refunds

How to Cancel

You can cancel your subscription at any time in your Apple ID settings:

1. Open Settings on your iPhone or iPad
2. Tap your name → Subscriptions
3. Select Makoto+ Japanese Explorer
4. Tap Cancel Subscription

You'll continue to have access until the end of your current billing period.

Note: Deleting your App or website account does not cancel your Apple subscription. You must cancel directly in your Apple ID settings.

Refund Policy

Refunds are handled exclusively by Apple according to their policy. To request one:

Note: Any unused portion of a free trial is forfeited when you purchase a subscription.

4. Educational Use Only

The App is designed for Japanese language learning and cultural education. It is not a certified academic or testing service. All learning results depend on individual effort and study habits. No guarantee of language proficiency or test performance is implied.

5. Account Registration

Some features may require creating an account. You agree to provide accurate information, keep your credentials secure, and notify us of unauthorized use. We may suspend accounts violating these Terms.

6. License and Restrictions

We grant you a limited, non-transferable, revocable license to use the App for personal, non-commercial learning. You may not copy, modify, sell, or reverse-engineer any part of the App or its content.

7. Intellectual Property

All text, images, audio, software, and learning materials are owned by Kotoba Inc or its licensors. All rights reserved. You may not reproduce or distribute any content without written consent.

8. Privacy

Your privacy matters to us. Please review our Privacy Policy for details on data handling.

9. Disclaimer and Limitation of Liability

The App is provided "as is." We make no warranties, express or implied. To the extent permitted by law, Kotoba Inc is not liable for indirect or consequential damages or loss of data, income, or opportunity arising from use of the App. Total liability shall not exceed amounts paid in the 12 months prior to the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability; in such cases, those provisions apply only to the extent permitted by applicable law.

10. Apple App Store Terms

Apple is not responsible for the App's maintenance or support. In case of defects, contact Apple for a refund. Apple is a third-party beneficiary to these Terms and may enforce them.

11. Children's Privacy

The App is not intended for children under 13. We do not knowingly collect personal information from children.

12. Changes to These Terms

We may update these Terms periodically. The "Last Updated" date will reflect any changes. Your continued use after updates means you accept the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States. Disputes shall be resolved by binding arbitration under the American Arbitration Association rules, except for small claims cases. Class actions are waived to the fullest extent permitted by law.
